Circumstances in which the lawyer or paralegal must provide legal argument to the court or tribunal or administrative board on sentencing outcomes or dispositions which may not be in accordance with their clients’ instructions or wishes. Generally, the lawyer or paralegal must make legal submissions in accordance with the applicable law and range of sentencing, but this may involve presenting evidence that the client may not wish the court or tribunal or board to necessarily take into account or act upon.
This topic will assist attendees to identify these points, timelines and understand various situations to act proactively and avoid such conduct for the best interest of their practice and public and or clients.
